From the very beginning of Malachi York's false arrest and subsequent trial, he has been publicly lynched by the media and the government in an effort to eradicate a progressive African American movement geared towards the upliftment of the Nubian race. His struggle is a part of the continuum of African American teachers and leaders martyred and imprisoned for their efforts.
Since the beginning of the unjust case against Reverend Dr. Malachi Kobina York, he has maintain and has provided evidence that verifies he was framed in a conspiracy to imprison him based on false allegations of molestation. Since his arrest, Malachi K. York has received unconstitutional, torturous and unjust treatment by the judicial system. There have been continuous efforts to obtain his freedom by allowing the truth about Rev. Dr. Malachi K. York's case be heard.
After muddling through a host of attorneys that provided ineffective assistance of counsel, Attorney Adrian Patrick and Benjamin Davis were brought on as lead attorneys after Malachi York's original attorneys from the Garland Firm were fired. Attorney Patrick and Davis had only 8 days to prepare for one of the biggest trials of the decade. They struggled with the biased court to free Malachi York. He has passed several arguments, exposed judicial misconduct as well as prosecutorial vindictiveness. This site highlights his arguments as to why the indictment and superceding indictment brought by the Federal Government on Malachi York should have been dismissed because of lack of evidence, why this case should have never made it to trial and why Rev. Dr. Malachi Kobina York's conviction should be reversed and in alternative, given a new trial.

Ineffective Assistance of Council
There are several reasons why Dr. Malachi Kobina York should have been released from prison. The first is, of course, HE IS ABSOLUTELY INNOCENT OF ALL THE ALLEGATIONS THAT WERE PRESENTED IN THIS CASE!!! Second, the federal government failed to produce any physical evidence to prove Dr. York made any illegal acts. And third, the court blatantly violated Dr. York's right to effective assistance of council.
A few weeks before trial, Dr. York FIRED the Garland Firm. Dr. York never hired them in the first place. Up until that time, the Garland firm hadn't so much as interviewed one witness. They were purposely trying to set Dr. York up for a public lynching. So Attorney Adrian Patrick was brought on. With only a couple of weeks to prepare, Attorney Patrick asked for a continuance to review the 30 books of evidence obtained through discovery. Judge C. Ashley Royal denied Attorney Patrick a continuance. Two weeks to prepare for a trial of this magnitude is utterly biased and racist. Dr. York deserves to be free. If you look at this case from an objective standpoint, you'd see for yourself how an serious injustice has been committed. It's time to take action!!
